Designing a Model for an Artificial Intelligence Crime Compensation Fund Based on Jurisprudential Principles

Abstract

The rapid advancement of artificial intelligence technology has created new challenges in the field of civil and criminal liability. One of the most important challenges is how to compensate for damages caused by crimes committed by intelligent systems. This research aims to design a model for an AI crime compensation fund based on jurisprudential standards. The research method is qualitative, employing content analysis of jurisprudential and legal texts. The findings indicate that, by invoking jurisprudential rules such as "la darar," "tasbib," and "ghurur," the Sharia foundations of the proposed fund can be established. The proposed model comprises three levels of participants (manufacturers, users, and intelligent systems), financial resources (fines, insurance, and taxation), and a compensation mechanism (a capped system). The findings indicate that the fund is jurisprudentially feasible and that enacting relevant legislation in this field is necessary.
