Retraction Policy

The purpose of this retraction policy is to provide guidelines for the retraction of articles published in TCHES. Retractions are undertaken in cases of serious errors or ethical concerns that significantly impact the validity and reliability of the published work. The IACR is committed to maintaining the highest standards of academic integrity and transparency.

 

Grounds for Retraction

Articles may be retracted for various reasons, including but not limited to:

 

·         Plagiarism

·         Falsification or fabrication of data

·         Authorship disputes

·         Unethical research practices

·         Substantial errors in data or conclusions

·         Use of unauthorized data or content

·         Copyright violations

·         Compromised peer review process

Retraction Procedure

Anyone can bring potential issues to the attention of the Editors-in-Chief. The Editors-in-Chief will conduct a preliminary investigation to determine the validity and seriousness of the concerns raised and may forward this to appropriate IACR Committee (e.g., the IACR Ethics Committee). If the concerns are deemed valid, the corresponding author(s) will be contacted to provide an explanation. Finally, if a retraction is deemed necessary, the corresponding author(s) will be informed.

 

Retraction Notice

When a retraction is deemed necessary a retraction notice will be published in the form of an errata, clearly stating the reasons for retraction. The notice will be linked to and from the original article online.

[A] Editors

•             All journals have an editorial board whose members are recognized experts in the field. The members of this board can be found on the journal’s website on www.kluwerlawonline.com.

•             All journals are peer-reviewed by the journal editors, editorial board members and/or selected reviewers. The procedure for peer-review differs per journal and can be found in the journal guidelines which can be can be found on the journal’s website .

•             All journal editors are required to sign a contract stating that:

o             The Editor warrants:

             To exercise his best judgment in only accepting original contributions, which have not been published before;

             To arrange the appropriate refereeing of the contributions submitted for publication in the Journal;

             To ensure that contributions accepted for publication and forwarded to the Publisher will be accompanied by a ‘Consent to Publish’ form signed by the contributors. It is understood that the contributors will be responsible for obtaining permission to use copyright material such as quotations, reproductions of data, illustrations and any other material which may be used in their contributions and that consequently liability for breach of such copyright shall rest with the contributors;

             To see to it that no contribution shall contain anything which is obscene, indecent or of a libellous or scandalous character, or otherwise infringes rights of third parties;

             That contributors shall be instructed to compose typescripts in accordance with the ‘Authors’ Guide for Submitting Manuscripts’ as supplied by the Publisher;

             To provide a timely in-flow of manuscripts sufficient to fill the journal’s announced annual publication schedules.

o             It is understood that the contributors shall be responsible for the proofreading - within the period mentioned in the instructions accompanying the proofs - of their own contributions. Should the contributor fail to do so, the Editor shall assume responsibility for prompt and proper correction.

o             Correction of copy-edited manuscript and proofs by the Editor/contributors shall be in accordance with arrangements made by the Publisher and the Editor/contributors. Changes in the proofs at variance with the manuscript must have the Publisher’s approval, and may be charged by the Publisher to the Editor or, as the case may be, to the contributors.

[B] Authors

        •    All journal authors are required to sign a Consent to Publish stating that:

o   The Author warrants and represents that the Contribution does not infringe upon any copyright or other right(s), and that it does not contain infringing, libellous, obscene or other unlawful matter, that he/she is the sole and exclusive owner of the rights herein conveyed to the Publisher, and that he has obtained the necessary permission from the copyright owner or his legal representative whenever a passage from copyrighted material is quoted or a table or illustration from such material is used. The Author will indemnify the Publisher for, and hold the Publisher harmless from any loss, expense or damage occasioned by, any claim or suit by a third party for copyright infringement or arising out of any breach of the foregoing warranties as a result of publication of the Contribution. The Contribution shall be delivered to the Publisher free of copyright charges.

o   The Author warrants and represents that the Contribution to the Journal has not been previously published elsewhere, or that if it has been published in whole or in part, any permission necessary to publish it in the Journal has been obtained and provided to the Publisher together with a statement of the original copyright notice.

o   The Author agrees to be named as author of his Contribution. The Author declares and warrants that any person named as co-author of the Contribution is aware of that fact and has agreed to being so named. The Author signs this agreement also on behalf of and in the name of each co-author, who hereby agrees with this agreement in full. The Author warrants and represents that he is empowered by any co-author to represent this co-author in signing this agreement in their name.
